REVIEW EDITION / NAME & OPERATING TERMS PENDING / NO FUNDS ACCEPTED

01 / BANK INSTRUMENTS & SECURITIES

An instrument is not cash.
The terms make the difference.

Begin with what the instrument actually is, who issued it and what rights the holder can exercise. Only then can a potential structure be evaluated.

UNDERSTAND THE ASSET

Different instruments.
Different obligations.

Standby letters of credit and guarantees

Review the issuer’s undertaking, beneficiary, drawing conditions, governing rules and any transfer or assignment restrictions. A face amount is not an account balance or a promise that another party will lend against the document.

Notes and marketable securities

Medium-term notes and government securities require their own issuer, custodian, ownership, marketability and settlement review. They should not be described as interchangeable with an SBLC.

Background: OCC Trade Finance and Services.

THE REVIEW FILE

Evidence before an advance rate.

01

Issuer and authenticity

Independent issuer or custodian confirmation through verified channels, not a forwarded contact or screenshot alone.

02

Ownership and enforceable rights

Beneficiary or holder status, signatory authority, terms, expiry, claims, liens and restrictions.

03

Counterparty and economics

A named recipient’s acceptance criteria, valuation basis, fees, collateral rights and any proposed financing amount.

04

Control and exit

Who controls the asset, permitted use, reporting, release conditions and what happens if the transaction cannot proceed.

THE NEXT STEP

Start with the asset.
Not the promise.

A short, non-sensitive inquiry is the starting point. Eligibility, counterparties and terms must be confirmed before any transaction.
